(MANDO/REST PERIOD)
An employee who has been assigned mandatory overtime will be afforded a period of not less than 9 hours rest from the completion of the mandatory overtime until the start of the employee's next scheduled shift. In the event that this rest period extends into the employee's next scheduled shift, the employee may elect to have the scheduled start time of their next shift adjusted to provide for an off-duty period of a minimum of 9 hours.
- In circumstances where the reduced rest period is solely a result of a mandatory overtime requirement, the employee will be paid straight time rates for all hours lost due to such adjustment
- In circumstances where employee shift swaps or acceptance of voluntary overtime contribute to the reduced rest period, employees electing to adjust the start time of their next shift may either end their shift at their regularly scheduled end time and be paid for hours worked or adjust the end time of their next scheduled shift to provide for a full shift.
I'm working my shift. I get mandatory OT. 9 hours rest. My shift the next day gets adjusted. I get paid for any hours lost the next day because of the mandatory OT It depends. Were either of these shifts trades that you picked up? Were either of these shifts voluntary OT? If there was a trade on either day, or voluntary OT on either day, you would still get the 9-hour adjustment if you asked for it, but the adjusted hours would be unpaid. Let’s say we have to back up your morning start by 3 hours to give you 9 hours between...those 3 hours would be unpaid, but you could opt to put the 3 hours at the end if the next day shift, so you won’t be short of the number of hours you were originally scheduled. It is only paid when it is *scheduled shift to scheduled shift” so it will typically only happen on Sunday night to Monday on a shift bid, or for mando rest period.
- Open time employees, because we can’t schedule you with less than 9 hours rest, and most of our shifts have the same start time every day.
Let’s say from one bid to the next you are off at 11p on Sunday, and your new shift is at
If you are assigned Mando after 11p and you start your new shift at 0800, if we have to adjust that 0800 to later, that is the only time it is paid rest (a) above.
Most of all circumstances with reduced rest fall under letter (b) above.
- I'm on a CS and get mandatory OT. 9 hours rest. My shift the next day gets adjusted, do I get paid? If you requested the adjustment, you would get the full 9 hours off, but none of the adjusted time is paid because the acceptance of that CS contributed to the reduced rest (if you hadn’t picked up the trade, you would not have been there to be assigned Mando)
- I'm working my shift, and I get mandatory OT. 9 hours rest. CS the next morning. My CS shift gets adjusted; do I get paid? If you request the 9-hour adjustment we will give it to you, but if it is unpaid, you can choose to tack the missing hours on to the end of the shift if you want. (again, if you hadn’t had the trade the next morning, no adjustment would have been necessary....so the shift swap contributed to the reduced rest)
